New Measure for the Distribution of Revenues from the Commercialization of Intellectual Property – A Transparent and Motivating System

On December 12, 2024, the Faculty of Medicine of Masaryk University implemented Measure No. 6/2024: Intellectual Property at the Faculty of Medicine, Masaryk University. This measure establishes clear rules for the settlement of authors from the Faculty of Medicine following the commercialization of their know-how and employee works. This represents another step in strengthening the Faculty of Medicine of Masaryk University's role as an institution that supports innovation and technology transfer.

What Does the Measure Bring?

The measure supplements Directive No. 10/2013 – Intellectual Property and was created to introduce a fair and motivating system that rewards authors and creators of intellectual property for their contributions. It defines the shares of net commercialization proceeds as follows:

The proceeds are further distributed among individual authors based on their shares specified in the Registration sheet of Know-How/Employee Work of the Faculty of Medicine. This record is included as Annex No. 1 of the regulation, and its editable version can be downloaded using the button below.

The Faculty of Medicine has taken a much more generous approach compared to some national and international systems. This approach reflects an effort to motivate academics to actively engage in the commercialization process, thereby supporting the transfer of research results into clinical practice.

For instance, at Brno University of Technology, the inventors' share of commercialization revenues is set so that if the net proceeds exceed CZK 500,000, the inventors receive less than half of the share they would under the Faculty of Medicine's rules. Internationally, the situation differs in Germany, where the inventors' share is fixed at 30% of the net commercialization proceeds, regardless of the amount. This share is explicitly stated in the Employee Inventions Act (Arbeitnehmererfindungsgesetz).

The newly created system at the Faculty of Medicine is based on the idea that a more generous share for inventors will encourage their engagement in commercialization activities. This approach also reflects the effort to better reward those contributing to innovations with high application potential. The anticipated outcome is an increase in the number of successfully commercialized research results, which will enhance the faculty's prestige and its broader societal and economic impact.

This measure includes detailed procedures for recording know-how and employee works, calculating net commercialization proceeds, and subsequently dividing them between the inventors and the faculty. The measure also contains a precise methodology for deducting overhead and other faculty expenses, ensuring maximum transparency.
